The prepaid medicine contract is a legal business through which one of the parties provides health services with higher quality standards for those who enter into the agreement. In Colombia, the prepaid medicine contract is atypical, since the parties have autonomy to establish the clauses that will be applied according to their needs. This has led to abuses in some cases by the entities that provide the prepaid medicine service, because in addition to being an atypical contract, it is adhesion. In the brief I will present the general guidelines of the contract based on those indicated in some Decrees issued by the National Government and in the jurisprudence of the Constitutional Court.

El contrato de medicina prepagada es un negocio jurídico mediante el cual una de las partes presta servicios de salud con mayores están-dares de calidad para quienes celebran el convenio. En Colombia, el contrato de medicina prepagada es atípico, pues las partes tienen autonomía para establecer las cláusulas que se van a aplicar según sus necesidades. Esto ha llevado a que en algunos casos se presenten abusos por parte de las entidades que prestan el servicio de medicina pre-pagada, pues además de ser un contrato atípico es de adhesión. En el escrito presentaré los lineamientos generales del contrato partiendo de los señalados en algunos Decretos expedidos por el Gobierno Nacional y en la jurisprudencia de la Corte Constitucional.
