The thesis addresses the question of to what extent the regulation of Section 1371, Paragraph 1 of the German Civil Code (BGB) and, in this context, the statutory inheritance rights of spouses (§ 1931 BGB) should be reformed. The author advocates for an expansion of the statutory inheritance rights of spouses and the implementation of an actual equalization of gains in the event of the dissolution of the marriage by death.
